At Cento, we take privacy very seriously. This Privacy Policy explains how Cento Fine Foods, Inc. (collectively, “Cento,” “we,” “us,” or “our”) collects, uses, discloses, or otherwise processes your personal information and explains how we may use your personal information, your choices and rights you may have depending on the applicable law in your jurisdiction.

This Privacy Policy applies to all personal information that is collected by Cento during any written, electronic, and oral communications online or offline when you:

  • Visit our websites, pages, features or content that links to this Privacy Policy, such as the websites located at cento.com and shop.cento.com.

  • Otherwise interact with us, such as when you sign up for an appointment, contact our customer support via calls or emails, or participate in official surveys and sweepstakes (“Activity(ies)”); or

  • Interact with social media pages that we control (“Social Media Page(s)”);

  • Engage our products or services that link to this Privacy Policy (collectively, including the Sites, Activities, and Social Media Pages, the “Service(s)”).

This Privacy Policy does not apply to the personal information we collect from employees, contractors, job applicants, owners, directors or officers of Cento.

By accessing, visiting or using our Services, you acknowledge this Privacy Policy. If you are not comfortable with any part of this Privacy Policy, please immediately discontinue access or use of our Services.

We may revise this Privacy Policy from time to time and when we update it, we will post the date it was last updated at the top. We will provide additional notice to you if we make any changes that materially affect your privacy rights as required under the applicable law.

Personal information is generally any information that relates to you, identifies you personally, or could be used to identify you. The definition of personal information (used interchangeably with “personal data”) that applies for you in relation to this Privacy Policy depends on the applicable law, which is typically determined based on your state residency or location at the time of data collection. We may collect the following categories of personal information, depending on how you interact with our Services:

1. PERSONAL INFORMATION WE COLLECT

Information You Voluntarily Provide to Us. We, or service providers that assist us in providing, maintaining, and operating our Services, may collect the following types of personal information from you:

  • Newsletters and Alerts Sign Up. You may sign up through our Sites to receive electronic newsletters, marketing and promotional emails from us, including custom tutorials, exclusive sale access, exclusive promo codes and more. To sign up, we may ask you to provide email address. We may also use this information to tailor our newsletters to reflect your preferences. You can choose at any time not to receive marketing emails from us by clicking on the unsubscribed link within our marketing emails.

  • Partnership Inquiries. When you inquire about strategic partnerships with us, including carrying Cento products in your retail store as a retailer, distributing our brands within your market as a distributor, or utilizing our products in a foodservice operation, we may collect your company and contact information (name, title, company/store name, business address, state, business phone number, business email address, company website), and your partnership interests through online forms so we can evaluate opportunities and respond with relevant options. If you would like to work together with Cento as a marketing/social media partner, we may collect your full name, email address, phone number, social media handles, personal website, and any media kit you would like to provide.

  • Contact Us Forms. We may collect your or your name, email, phone number, home address, order number, store location, transaction information, product name, product UPC code, production code, and other additional information you choose to provide when you inquire or submit concerns about our products or services, or if you would like to get in touch with us. If you provide contact information, we may contact you to respond to your inquiries, to learn about your level of interest in, or satisfaction with our Services.

  • Account Registration. When you shop in our online store and choose register an account with us, we may collect your first and last name, and email address, so that we may communicate with you and provide you with the Services.

  • Order Placement. We may collect your personal information when you place an order through our Services, including, for example, your first and last name, delivery address, postal code, email address, phone number, payment account or credit card information.

  • Payment Information. If and when you purchase a product or service through our Services, you will need to provide us with a credit card for payment, including billing information such as your billing address, phone number, and name on the payment card.

  • Customer Support. When you engage with our support team and customer support providers, we may collect records, copies of your correspondence (including email addresses), or additional information you choose to share with us.

  • Promotional Activity (“Promotion”). If you choose to participate in a Promotion through our Services, we will collect and store the personal information you provide in connection with your participation in the Promotion, which may include, your name, date of birth, address email address, phone number, and/or other personal information identified in the Promotion terms. We use the personal information you provide to administer our promotions. We also may use your personal information to communicate with you about our products, services, and other promotions.

  • Feedback or Surveys. We may provide you with the opportunity to participate in surveys or provide feedback about your experience. If you participate, we may request certain personal information from you, typically including contact information (such as name and email address). Participation in these surveys is entirely voluntary. We use this information to improve our services and offerings.

Information We Automatically Collect. To the extent permitted under applicable law, we may automatically collect certain types of data about you when you use or interact with our Services, including visiting our Stores, which is considered personal information.

  • Usage Data. When you browse our Sites or Apps, we automatically collect data such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed, the order of these page views, the date and time you access our servers, and other diagnostic data.

  • Device Information. When you use your desktop or mobile devices to access our Services, we may be able to identify your device’s unique device identifier, MAC address, operating system, and your mobile device’s advertising ID.

  • Location Information. When you use our Services, we may infer the generic physical location and geographic regions of your device from your Wi-Fi, Bluetooth and other device settings. For example, your IP address may indicate your general geographic region. When you consent, we may collect your mobile device’s precise geo-location to find the closest property near you. You may choose not to share your location details with us by adjusting your mobile or desktop device’s location services settings.

Information We Collect from Third Parties. From time to time, we may obtain personal information about you from third-party sources as required or permitted by law. These sources may include:

  • Social Media. We may offer you the opportunity to engage with our content on or through third-party social networking websites, plug-ins and applications. When you engage with our content on or through third-party social networking websites, plug-ins and applications, you may allow us to have access to certain information associated with your social media account (e.g., name, username, email address, profile picture, gender) to deliver the content or as part of the operation of the third-party website, plug-in or application. When you provide information from your social media account, we may use this information to personalize your experience on our Services and on the third-party social networking websites, plug-ins and applications, and to provide you with other products or services you may request. Please note, social media features and widgets may be hosted by a third party. Your interactions with those features are governed by the privacy policies of the companies that provide them.

  • Third Party Partners. Unless prohibited by applicable law, we may obtain your personal information from marketing partners, analytics providers, Promotion providers, and other third-party partners to market to you, including to match custom audiences or create lookalike audiences on social media or other marketing platforms so that we can better understand which of our Services may be of interest to you, market our Services to you, and to provide us information necessary to improve our Services.

2. HOW WE USE YOUR PERSONAL INFORMATION

The personal information we collect is used for a variety of purposes, including activities such as: processing transactions, helping our customer care representatives resolve issues, identifying fraud and improving our services. In addition, information we collect improves your experience by delivering more personalized interactions and advertising. Also, we use information we collect for reporting and analysis purposes. We examine metrics such as how you are shopping on our Site, the performance of our marketing efforts and your response to those marketing efforts.

We will only use your personal information as described in this Privacy Policy or as disclosed to you prior to such processing taking place.

  1. To Provide Our Services. We will use your personal information to provide information or perform Services that you request, including to address your inquiries, complete transactions, fulfill orders, arrange deliveries or return purchases.

    Our online store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your credit card information is stored through Shopify’s data storage, databases and the general Shopify application. If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data.   2. To Provide Service-Related Communications. We will send you administrative or account-related information to keep you updated about your account and the Services. Such communications may include information about Privacy Policy updates, confirmations of your account actions or transactions, security updates or tips or other relevant transaction-related information. We process your contact information to send you such communications. Service-related communications are not promotional in nature. You are unable to unsubscribe from such communications, otherwise you may miss important developments relating to your account or the Services.

  3. To Provide Customer Support or Respond to You. We collect any information that you provide to us when you contact us. Without your personal information, we cannot respond to you or ensure your continued use and enjoyment of the Services.

  4. To Provide Marketing Communications. If you have voluntarily provided your email address, phone number or other electronic addresses to us when subscribing to our marketing and early access communications, we may email you about products, services, and promotions that we believe may be of interest to you. When you no longer wish to receive these marketing messages from us, you can opt out at any time by following the instructions contained in each email you receive from us or contacting us via the methods specified in the “How to Contact Us” section below.   5. For Research and To Develop Our Services. We may process your personal information and derive analytical and statistical data to better understand the way you use and interact with our Services. For instance, analyzing where, on which types of devices and how our Site is used, how many visitors we receive, and where they click on the Site may help us improve our existing Services and build new Services.   6. To Infer Your Interest and Personalize Your Experience. We may process your information to personalize your experience on the Services by presenting products and offers tailored to you. We may use such information to enable you to interact with our Services more easily across devices, or to recommend more relevant content to you. For example, when you enable the social sharing functionalities of your social media account(s) by interacting with our content on or through third-party social networking websites, plug-ins and applications, we may use this information to personalize your experience on our Services and on the third-party social networking websites, plug-ins and applications.

  7. To Ensure the Security of the Services. We care about keeping you secure and safe while using our Services. Keeping you safe requires us to process your personal information, such as your device information, activity information and other relevant information. We use such information to combat spam, malware, malicious activities or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information. We cannot ensure the security of our Services if we do not process your personal information for security purposes.

  8. To Enforce Compliance with Our Terms, Agreements or Policies. When you access or use our Services, you are bound to our Terms and Conditions. To ensure you comply with them, we process your personal information by actively monitoring, investigating, preventing and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services. Subject to the applicable law, we may also process your personal information to investigate, prevent or mitigate violations of our internal terms, agreements or policies and enforce our agreements with third parties and business partners.

  9. To Facilitate Corporate Acquisitions, Mergers and Transactions. We may process any information regarding your account and your use of our Services as is necessary in the context of corporate acquisitions, mergers or other corporate transactions.

  10. To Maintain Legal and Regulatory Compliance. Our Services are subject to certain laws and regulations which may require us to process your personal information. For example, we process your personal information to pay our taxes, to fulfill our business obligations, ensure compliance with employment and recruitment laws or as necessary to manage risk as required under applicable law. Without processing your personal information for such purposes, we cannot perform the Services in accordance with our legal and regulatory requirements.

  11. With Your Consent. For any other purpose disclosed to you prior to you providing us your personal information or which is reasonably necessary to provide the Services or other related services requested, with your permission or upon your direction.

3. HOW WE SHARE YOUR PERSONAL INFORMATION

Other than sharing your personal information so that you can use our Services, or as required or permitted by law, we do not share personal information about you with non-affiliated third parties. We may share information to third parties as disclosed in this Privacy Policy, but we do not, and will not sell your personal information to third parties for money. We disclose your personal information as described below.

Our Corporate Organization. We may disclose some or all of your personal information with our subsidiaries and corporate affiliates, joint ventures, or other companies under common control with us for the purposes described in this Privacy Policy unless otherwise prohibited by applicable law or by contractual agreement with our vendors, service providers or other third parties.

  2. Service Providers. We may disclose your personal information with service providers acting on our behalf to help us operate our Services. Service providers and vendors provide us with support services, such as: assisting us in e-commerce operations; managing a database of customer information; hosting the Sites; designing and/or operating the Sites’ features; tracking the Sites’ activities and analytics; enabling us to send you special offers or perform other administrative services; delivery and shipping; operating our customer support and processing partnership inquiries; and other services designed to assist us in maximizing our business potential. These service providers may have access to or process your personal information only for the purpose of providing services to us.

  3. Maintain Legal and Regulatory Compliance. We may disclose your personal information law enforcement authorities, government or public agencies or officials, regulators, and/or to any other person or entity having appropriate legal authority or justification for receipt of your information if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Cento or third parties (including through the enforcement of this Privacy Policy, our Terms of Use, and other applicable agreements and policies); or (ii) comply with legal and regulatory obligations (e.g., pursuant to law enforcement inquiries, subpoenas, or court orders).

  4. During Business Transfers; Bankruptcy. In the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets, any personal information owned or controlled by us may be one of the assets transferred to third parties. We reserve the right, as part of this type of transaction, to transfer or assign personal information and other information we have collected from users of the Services to buyers, service providers, advisors, potential transactional partners or other third parties in connection with the advisors, potential transactional partners or other third parties of a corporate transaction. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Privacy Policy. However, any information you submit or that is collected after this type of transfer may be subject to a new privacy policy adopted by the successor entity.

  5. Third Party Analytics and Interest-based Advertising Partners. We use third-party analytics, advertising, and marketing providers to collect information about your use of the Sites, see the overall patterns of usage on the Sites, deliver advertisements to your social media account based on email addresses, optimize ad performance, and determine whether our advertising is effective. Where permitted by applicable law, we may share your personal data with marketing and advertising partners for targeted advertising purposes, such as matching custom audience or creating lookalike audience on social media or other marketing platforms, so that we can better understand which of our Services may be of interest to you, market our Services to you, and to provide us information necessary to improve our Services.

  6. Consent. We may disclose your personal information for any purpose with your consent.

4. COOKIES AND OTHER SIMILAR TRACKING TECHNOLOGIES

We and our third-party partners and service providers (such as advertisers and analytics providers) may use cookies and similar digital tracking technologies (such as pixels, web beacons, and tags) (collectively, “Tracking Technologies”) on our Services to gather information when you interact with our Sites and Services. These Tracking Technologies help us operate our Services, understand your usage, improve functionality, and, depending on your choices and where you live, deliver and measure advertising.

Tracking Technologies can be placed on our Services by us or by third-party partners we engage for our purposes. Third-party cookies may also be deployed on our behalf on third-party websites (e.g., to measure the effectiveness of ads).

Types of Tracking Technologies

We may use the following types of Tracking Technologies on our Sites and Services:

  • Necessary. These Tracking Technologies are required for the operation of Services. These Tracking Technologies do not gather information about you for marketing purposes.

  • Functional. These Tracking Technologies are used to recognize you when you return to Sites and Services. They remember the choices you make (such as your username, or the region you are in) and the changes you make to text size, fonts and other features you can customize. While these Tracking Technologies can be disabled, this may result in less functionality during your use of our Sites and Services.

  • Analytics/Performance. These Tracking Technologies allow us and our analytics service providers/processors to count visits and traffic sources, or test new features, so that we can measure and improve the performance of our Sites and Services, including as part of our analytics practices to improve the content offered. They help us understand how visitors use our Sites and Services, which site or page the user came from, the number of each user’s visits and how long a user stays on the Sites and Services.

  • Advertisement. These Tracking Technologies may be set through our Sites by our advertising partners to deliver content, including ads, that are relevant to your interests across your devices, based on how you interact with our advertisements or content. They may be used by our advertising partners to build a profile of your interests and to show you relevant ads on other sites. They do not store directly personal data but are based on uniquely identifying your browser and internet device. If you do not allow these Tracking Technologies, you will experience less targeted advertising.

Why We Use Tracking Technologies

We may use these Tracking Technologies for the following purposes:

  • Recognizing you when you sign in to use our Sites. This allows us to provide you with recommendations, display personalized content, recognize you as an account holder, and provide other customized features and services.

  • Keeping track of your specified preferences.

  • Conducting research and diagnostics to improve content on our Sites.

  • Preventing fraudulent activity and improving security.

  • Delivering content, including ads, relevant to your interests, and measuring the effectiveness of the ads and marketing activities.

  • Enabling basic functioning of our Sites supporting online browsing and shopping with us.

How to Manage Your Tracking Technologies Preferences

Your Privacy Choices. Please refer to Section 10 below for more information about whether you have the right to opt out of sales and targeted advertising, and if so, how to exercise that right. Please note that you may still receive generalized ads after opting out. Your opt-out choice will only apply to your use of our Services through the current browser or device you are using and only so long as that browser’s cookies are not erased.

Global Privacy Control. Where required by applicable law, we will also honor browser-based opt-out preference signals such as the Global Privacy Control (GPC). The Global Privacy Control signal is currently the only opt-out preference signal we recognize. You can visit the Global Privacy Control official site to learn how to configure your device to send such signals. We will honor and process the opt-out preference signal in a frictionless manner. Your opt-out choice will only apply to your use of our Site through the current browser or device you are using and only so long as that browser’s cookies are not erased. You will need to submit a separate opt-out of sharing request on each device and browser you use to visit our Sites to completely opt out using this method. Opting Out of Third-Party Analytics. We may use third-party service providers to monitor and analyze the use of our online, web-based, and mobile-based Services, such as Google Analytics. Google Analytics is an analytics service offered by Google LLC (“Google”) that tracks and reports website traffic. Disabling Certain Interest Based Advertising

Interest Based Advertising - Website Browser. Many advertising companies that collect information for interest-based advertising are members of the Digital Advertising Alliance (DAA), which maintains websites where people can opt out of interest-based advertising from their members. To opt out of website interest-based advertising provided by each organization’s respective participating companies, visit the DAA’s opt-out portal available at aboutads.com.

5. SECURITY

To protect your personal information, we use commercially reasonable administrative, technical, and physical safeguards, take reasonable precautions and follow industry standard to help protect and secure your personal information so that it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. However, no information system can be 100% secure. As a result, we cannot guarantee the absolute security of your personal information. Moreover, we are not responsible for the security of information that you transmit to the Services over networks that we do not control, including the Internet and wireless networks.

Please recognize that protecting your personal information is also your responsibility. We ask you to be responsible for safeguarding your password, secret questions and answers and other authentication information you use to access our Services. If you feel that the security of your account or personal information has been compromised, please immediately contact us. Please be aware that, despite our best efforts, no security system is impenetrable. In the event of a security breach, we will promptly notify you and the proper authorities if required by law.

6. RETENTION

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired. In addition, we retain your email address and information about your marketing preferences to ensure that we can honor those preferences.

If you send us correspondence, including emails, we retain such information electronically in the records of your account. We will also electronically retain customer service correspondence and other correspondence from Cento to you. We retain these records to measure and improve our customer service and to investigate potential fraud and violations.

We will also retain Site and Services usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Site, or we are legally obligated to retain this data for longer periods. We may also retain de-identified, aggregate Services usage data for internal analysis purposes.

If you wish to cancel your account or request that we no longer use your information to provide you Services, we may still retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We offer you certain choices about how we communicate with you and, if you are a registered user, you can manage the information in relation to your account.

    As a registered user with our online shopping sites, you can access, modify, or delete certain profile information at any time by logging into your account.

    We offer you certain choices about how we communicate with you and what information we collect from you. You can update your marketing preferences, limit the communications you receive from us, or submit a request by:

    • Using the unsubscribe function in the email you receive from us;

    Please note that we may still send you certain communications relating to your account or use of our Sites (such as administrative and service announcements), and these transactional account messages may be unaffected if you choose to opt out from receiving our marketing communications.

8. YOUR PRIVACY RIGHTS

Depending on applicable law where you reside or are located, and subject to the applicability of such law to Cento, you may be able to assert certain rights identified below with respect to your personal information. Please refer to the “What Rights Apply” section to determine the rights you have in your jurisdiction. If any of the rights listed below are not provided to you under the law that governs the processing of your personal information, we have absolute discretion in providing you with those rights.

Depending upon the applicable law, access to your rights under the applicable law may be denied: (a) when denial of access is required or authorized by law; (b) when granting access would have a negative impact on another's privacy;; (c) to protect our rights and properties; or (d) where the request is frivolous or vexatious, or for other reasons.

Your privacy rights may include the following:

  1. Right to Know/Access. You may have the right to obtain a copy, or a list of categories of personal data that we hold about you, as well as other supplementary information, such as the purposes of processing, and the entities to whom we disclose your personal data.

  2. Right to Correct/Rectification. You may have the right to correct any of your personal data in our records and systems. You may request us to rectify, correct or update any of your information by us that is inaccurate. In addition to the methods described below, you may be able to correct your information through your account settings.

  3. Right to Delete/Erasure. Under certain circumstances, you may have the right to request that we delete the personal data that we hold about you. This right is not absolute, and we may refuse such a request if there are compelling legitimate grounds for keeping your personal data, for legitimate purposes, or as required by law. In addition, in the event your deletion request is honored, we may retain a record of your deletion request as required under applicable law.

  4. Right to Portability. You may have the right to receive a copy of the personal data we have collected about you in a structured, commonly used and machine-readable format.

  5. Object to Automated Decision-Making. Cento does not employ automated decision making as part of providing its products or services to you where the decision would have a legal effect on you or produce a similarly significant effect.

  6. Right to Opt-Out of Sale / Right to Opt-Out of Sharing for Targeted Advertising. You may have the right to opt out of: (i) the sale of your personal data; and (ii) the sharing of your personal data for targeted advertising or profiling, as defined under applicable law. We use Tracking Technologies (as described in the “Cookies and Other Tracking Technologies” section above) and may disclose certain personal data to advertising partners. Under certain state laws, this may be considered a “sale” or “sharing” of personal data.

  7. Right Against Discrimination. We do not discriminate against any customers who exercise any of their rights described in this Policy.

  8. Right to Appeal. In certain jurisdictions, you may have the right to appeal if we refuse to take action on your rights request. Instructions on how to appeal will be provided to you upon such a denial, but in any event, such instructions will be substantially similar to those provided below for submitting requests.

  9. Right to Obtain Third-Party List. You may have the right to request a list of specific third parties to which we have disclosed personal data.

Submitting a Request to Exercise Your Rights

You may exercise your privacy rights by visiting our Privacy Rights Request Form or emailing us at privacy@cento.com with the subject line “Privacy Rights Request.” In your request, please make clear which right you would like to exercise and identify your state and country of residence. Once you have submitted your request, we will respond within the time frame permitted by the applicable law. Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

To protect your privacy, we must be able to verify your identity to confirm that the privacy rights request came from you.
